BEFORE THE TOWN COUNCIL OF THE TOWN OF DANVILLE
In the Matter of:
Granting Rezoning of Land
from A-4 to P-1 and Amending Ordinance No. 125
the Zoning Map of the Town.
The Town Council of the Town of Danville DOES ORDAIN AS FOLLOWS:
SECTION I. Findings.
The Town Council hereby finds as follows in support of the
rezoning and preliminary development plan applications:
1. The proposed PUD 85-5 and rezoning are consistent with the
current Danville General Plan: the Danville General Plan
designates the property single-family residential (135
acres) and general open-space (455 acres), with a density of
1 to 3 units per acre; the proposed PUD 85-5 and rezoning
provide for 257 single-family residential units which is
within the allowable density range; the proposed PUD 85-5
is further consistent with Danville's "Scenic Hillside and
Major Ridgeline Development", ordinance and
"Hillside/Ridgeline Guidelines", in terms of building
criteria, overall development, and project design.
2. a) The plan will constitute a residential environment of
sustained desirability and stability, and will be in harmony
with the character of the surrounding neighborhood and
community: the site plan is of sufficient quality, and is
similar to adjacent projects which have shown sustained
desirability and reliability, the lot sizes and proposed
designs are compatible with adjacent residential homes, and
lot sizes adjacent to nearby homes have been required to be
comparable (R-20) size;
b) The development of a harmonious, integrated plan
justifies exceptions from the normal application of the
Zoning Ordinance: the PUD 85-5 allows for flexibility and
adoption to the varied topography of the site, while
retaining an integrated plan and both internal and external
harmony;
c) The design objectives of the Contra Costa County Code
have been met: the current plan integrates such design
objectives and the Town's design review procedures are
r~quirmd to be followed:

d) The Applicant has stated that it will start construction
within two and one-half (2.5) years from the effective date
of zoning change and plan approval.
SECTION II. Rezoning.
The two parcels totalling 590 acres located south and west of
Blackhawk Road approximately one-half mile north of Camino
Tassajara (Accessor's Parcels 215-070-002 and 215-080-010)
otherwise known as the Magee Diablo Ranch project, and shown on
the attached Exhibit B, is rezoned from the Agricultural
Preserve (A-4) Zone District to the Planned Unit District
(P-l). Rezoning is based on the Preliminary Development Plan
for PUD 85-5, as conditioned by the requirements listed in
Exhibit A.
SECTION III. Zoning Map.
The zoning map of the Town of Danville is amended accordingly.
SECTION IV. Publication.
The City Clerk shall either a) have this ordinance published
once within 15 days after adoption in a newspaper of general
circulation or b) have a summary of this ordinance published
twice in a newspaper of general circulation once five days
before its adoption and again within 15 days after adoption.
SECTION V. Effective Date.
This ordinance becomes effective 30 days after its adoption.
The foregoing Ordinance was introduced at a meeting of the Town
Council of the Town of Danville held on October 5, 1987, and was
adopted and ordered published at a meeting of the Council held
on 0ct0ber 19 , 1987, by the following vote:
