The City Council of the City of Danville DOES ORDAIN as
follows:
SECTION 1. Chapter 7, consisting of sections 12-701 thorugh
12-706 is added to Title 12 of the Danville Municipal Code to
read as follows:
"Chapter 7
Truck Routes
Section 12-701 Definitions
Section 12-702 Prohibition of Use of City Streets
Section 12-703 Through Truck Route Established
Section 12-704 Weigh-In
Section 12-705 Exceptions
Section 12-706 Penalty
Section 12-701. Definitions.
In this chapter unless the context otherwise requires:
1. "restricted street" means all streets in the City
except through truck routes established in this
chapter;
2. "through truck route" means a street upon which the
unrestricted use of trucks is permitted;
3. "truck" means a vehicle exceeding a maximum gross
weight of 14,000 pounds.
Section 12-702. Prohibition of Use of the City Streets.
No person may drive or park or permit a vehicle exceeding a
gross maximum weight of 14,000 pounds to be driven or parked on a
restricted street within the City.
Section 12-703. Throuqh Truck Route Established.
a. The following streets are declared to be through truck
routes for the movement of trucks:

b. The City Council determines under the authority of
Vehicle Code section 35701(b) that the posting of an
appropriate sign as "through truck route" is the method
of designation which will best serve to give notice of
this chapter. This chapter is effective when
appropriate signs are erected as indicated.
Section 12-704. Weigh-In.
A police officer may require a person driving or in control
of a truck not proceeding over a through truck route to proceed
to a public or private scale available for the purpose of
weighing and determining whether this section has been complied
with.
Section 12-705. Exceptions.
This chapter does not apply to the following:
1. A truck coming from an unrestricted street having
ingress and egress by direct route to and from a
restricted street when necessary to make a pickup or
delivery of goods, wares and merchandise from or to a
building or structure located on a restricted street or
for the purpose of delivering material to be used in
the actual and bona fide repair, alteration, remodeling
or construction of a building or structure upon a
restricted street for which a building permit has
previously been issued;
2. School bus and passenger bus under the jurisdiction of
the Public Utilities Commission;
3. A vehicle owned or operated by a public utility or a
licensed contractor while necessarily in use in the
construction, installation or repair of a public
utility;
4. A vehicle owned or operated by the city or a vehicle
used for the removal of refuse under contract with the
City;
5. An authorized emergency vehicle.

Section 12-706. Penalty.
A person who violates this ordinance is punishable by a fine
of not more than $500, imprisonment for not more than six months,
or both. Each violation and each day during any portion of which
this ordinance is violated is a separate offense."
SECTION 2. Publication.
The City Clerk shall either a) have this ordinance published
once within 15 days after adoption in a newspaper of general
circulation or b) have a summary of this ordinance published
twice in a newspaper of general circulation, once five days
before its adoption and again within 15 days after adoption.
The foregoing ordinance was introduced at a meeting of the
City Council of the City of Danville held on Dece¥'!~ar i5
1986, and was adopted and ordered published at a meeting of the
Council held on J~uary 5 , 1987, by the following
vote:
