HomeMy WebLinkAbout101-86 BEFORE THE CITY COUNCIL OF THE CITY OF DANVILLE In the matter of: Restricting the Use of City Streets by Commercial Vehicles Exceeding a Maximum Gross Weight Limit of 14,000 Pounds, Providing ORDINANCE NO. 101 Penalties for Violation, and Declaring the Ordinance to be an Urgency Measure The City Council of the City of Danville DOES ORDAIN AS FOLLOWS: Section 1. Chapter 7 consisting of Sections 12-701 through 12-705 is added to Title 12 of the Danville Municipal Code to read as follows: Chapter 7 Truck Routes Section 12-701. Prohibition of Use of Certain Streets. No person may drive or park or permit a commercial vehicle exceeding a gross maximum weight of 14,000 pounds to be driven or parked on any street within the City. Section 12-702. Exceptions. Section 12-701 does not apply to a vehicle which is subject to sections 1031 to 1036 of the Public Utilities Code. Section 12-703. Pickups and Deliveries Permitted. A commercial vehicle coming from an unrestricted street having ingress and egress by direct route to and from a restricted street may enter and leave by direct route to and from a restricted street when necessary for the purpose of making a pickup or delivery of goods, wares, and merchandise from or to a building or structure located on a restricted street or for the purpose of delivering materials to be used in the repair, alteration, remodeling or construction of a building or structure upon the restricted street. Section 12-704. Exclusion of Vehicles Originating in the City. The prohibition of the use o~ mt~t~ $~t ~Q~th in ~G$iQn 12-701 does not apply to a vehicle described in section 12-701 which has its point of origin on a restricted street. -2- Section 12-705. Posting of Streets with Appropriate Siqns. Under the authority of Vehicle Code Section 35701 (b) the City Council determines that the posting of signs indicating the streets affected by sections 12-701 through 12-704 will best serve to give notice of these provisions. Sections 12-701 through 12-704 are effective when appropriate signs are erected as indicated. Section 2. Penalty A person who violates this ordinance shall be punished by a fine of not more than $500 or imprisonment for not more than six months, or both. Each violation and each day during any portion of which this ordinance is violated is a separate offense. Section 3. Declaration of Urgency and Effective Date This ordinance is declared to be an urgency measure for the immediate preservation of the public peace, health, and welfare. The facts constituting the urgency are as follows: Sycamore Valley Road and Camino Tassajara, E1 Cerro Boulevard, and Diablo Road, all of which are located in the City, provide through truck traffic to land use developments located east of and outside of the City limits. Camino Tassajara from its intersection with 1-580 in Alameda County and its extension northerly into Contra Costa County has also provided access to trucks serving those same land use developments. Prior to incorporation on July 1, 1982, the Board of Supervisors had designated Sycamore Valley Road and Camino Tassajara as a truck route. Although it purported to prohibit truck access on Camino Tassajara from the 1-580 intersection in 1979, trucks have continued to use both that access route as well as the Sycamore Valley Road-Camino Tassajara access routes. Recently, in reaction to complaints from residents on Camino Tassajara the Board of Supervisors reconfirmed its action of 1979 prohibiting truck access on Camino Tassajara to the extent that Camino Tassajara is located in unincorporated territory and directed strict enforcement of this prohibition. The affect of this action is to force all truck traffic onto Danville City streets. Through truck traffic from one point located outside the City to another point located outside the City of a magnitude created by the land developments east of the City boundary is a threat to the health and safety of the travelling public. Because the County's action deprives trucks of an alternate route, all through truck traffic would have to use Danville Streets. Many of the streets are residential, streets of narrow width, which do not have safety pathways or sidewalks for pedestrians. -3- Other streets are overcrowded shopping area streets. There are elementary schools located on or near residential streets without safe walkways. Sycamore Valley Road from its intersection with Interstate 680 and Camino Tassajara from its intersection with Sycamore Valley Road continuing in an easterly direction are adequate to handle some but not all of the truck traffic requiring access to land development east of Danville. Additionally, there are major school crossings on these through roads. This ordinance goes into effect immediately but its provisions are operative when appropriate signs are errected in accordance with Vehicle Code section 35701(b) and section 12-705 of the Municipal Code. Section 4. Publication The foregoing ordinance was introduced, adopted and ordered published at a meeting of the City Council of the City of Danville held on September 22, 1986, by the following vote: AYES: Kennett, Lane, McNeely, Offenhartz NOES: ABSENT: Schlendorf MAYOR
