Chapter 2 comprising sections 3-201 to 3-212, is added to Title 3 of the Danville Municipal Code to read as follows: "Chapter 2 Park and Leisure Services Commission Section 3-201 3-202 3-203 3-204 3-205 3-206 3-207 3-208 3-209 3-210 3-211 3-212 Creation of City Park and Leisure Services Commission Qualification Term of Office Removal or vacancy Absence from meeting Time and place of regular meeting No compensation Appointment of Chair, Vice Chair Adoption of rules Quorum Duties of officers of the Commission Duties and powers of the Commission Section 3-201. Creation of City Park and Leisure Services Commission A City Park and Leisure Sereices Commission of the City of Danville is established. The Park and Leisure Services Commission consists of seven members appointed by the City Council. Section 3-202. Oualifications. All members shall by experience, training, education, occupation or avocation, have demonstrated knowledge of and interest in park, recreation, cultural, or arts facilities, or leisure and human services. -1- Section 3-203. Term of Office. The term of office of each member is four years. However, of the members first appointed, four serve until December 31, 1988 and three serve until June 30, 1990. Each member serves until his successor is appointed and qualified. Section 3-204. Removal or vacancy. A member of the Commission may be removed by a majority vote of the Council. A vacancy is filled in the same manner as the original appointment. A person appointed to fill a vacancy serves for the remainder of the unexpired term. Section 3-205. Absence from meeting. If a member of the Commission is absent without cause from three regular meetings of the Commission in a twelve month period, the office becomes vacant automatically. The Commission shall immediately notify the City Council of the vacancy. A member is not absent without cause if the absence is (1) due to illness or (2) unavoidable and the member gives the secretary of the Commission notice before the day of the meeting giving the reason for the absence. Section 3-206. Time and place of regular meeting. The Commission shall hold at least one regular monthly meeting. The Commission shall fix the time and place of its regular meetings by resolution or by-law. Special meetings may be called as necessary. All meetings of the Commission are open to the public and the Commission shall give notice of its meetings as required by law. Section 3-207. No compensation. Members of the Park and Leisure Services Commission do not receive compensation for attendance at Commission meetings, but are entitled to reimbursement for expenses incurred in the course of their duties upon approval by the City Council. Section 3-208. Chair and Vice Chair. The Commission shall elect a Chair and Vice Chair from among its members. The Chair and Vice Chair serve for a term of one year and until the successor of each is elected and qualified. Section 3-209. Adoption of rules. The Commission shall adopt rules for the transaction of its business and shall keep a public record of its resolutions, transactions, findings and determinations. -2- Section 3-210. Ouorum. Four members of the Commission constitute a quorum for the transaction of business. Section 3-211. Duties of officers of the Commission. (a) Chair. The Chair shall preside at all meetings of the Commission. The Chair shall appoint all committees and shall perform all the duties necessary or incidental to the office. (b) Vice Chair. The Vice Chair is Chair in the absence or inability of the Chair to act. Section 3-212. Duties and Powers of the Commission. The Park and Leisure Services Commission shall: 1) be the primary advisory body to the City Council on acquiring and developing park, recreation, cultural, and arts facilities and providing leisure and human service programs for City residents; 2) recommend to the Council for adoption a comprehensive Park, Open Space, Trails, Public Facilities and Recreation Master Plan; review the Plan bi-annually and recommend revisions as needed to the adopted Plan; 3) hold public meetings, conduct surveys, and use other reasonable methods to determine community park, recreation, cultural, and human service needs and recommend actions to meet those needs to the City Council; 4) review site plans for public park, recreation, art, or cultural facilities and recommend plans and specifications to the Council for advertisement for bid; 5) review and comment on all subdivisions and other development proposals in which land is proposed for dedication, credit for private open space is requested, projects on school lands or other significant park, creek, trail, or open space concerns exist; 6) review and comment on the annual implementation of the Capital Improvement Program; 7) recommend to the Council for adoption facility use policies including fees, restrictions, priorities and other concerns and review the adopted policies and fees annually recommending changes as needed. 8) review, and recommend revisions to, the Community Beautification Plan as necessary; and 9) consider improvements to the condition of City recreation facilities annually; and 10) .perforun other duties prescribed by the Council." Section 2. Publication. The City Clerk shall either a) have this ordinance published once within 15 days after adoption in a newspaper of general circulation or b) have a su~nnary of this ordinance published twice in a newspaper of general circulation, once five days before its adoption and again within 15 days after adoption. Section 3. Effective Date This ordinance becomes effective 30 days after its adoption. The foregoing ordinance was introduced at a meeting of the City Council of the City of Danville on June 2, 1986, and adopted at a meeting of the City Council of the City of Danville on June 16 , 1986, by the following vote: AYES: Kennett, Lane, Offenhartz, Schlendorf NOES: McNeely ABSENT: None Attest:
