HomeMy WebLinkAbout65-85 BEFORE THE CITY COUNCIL OF THE CITY OF DANVILLE In the Matter of: Amending the Municipal Code ) ORDINANCE NO. 65-85 ($1-215) to Clarify That The ) Word "Shall" is not Intended ) TQ-~mDose a Mandatory Duty ) on the City ) ) The City Council of the City of Danville does ordain as follows: SECTION 1. A new section 1-215 is added to Title 1, (General Provisions) of the Municipal Code to read as follows: "Section 1-215. No ImDosition of Mandatory Duty. This code shall not be construed to impose on the City, its officers, employees or agents any greater liability than that required by law. The use of the word "shall" in any provision of this Code is not intended to impose upon the City, its officers , employees or agents a manda- tory duty of care toward persons or property within the City so as to provide a basis of civil liability for damages. This Code specifically preserves all immunities provided under the law to a public entity, its officers, employees and agents." SECTION 2. Effective Date. This ordinance becomes effective 30 days from its adoption. SECTION 3. Publication. The City Clerk shall either a) have this ordinance published once within 15 days after adoption in a newspaper of general circulation or b) have a summary of this ordinance published twice in a newspaper of general circulation, once 5 days before its adoption and again within 15 days after adoption. -1- The foregoing ordinance was introduced at a meeting of the City Council of the City of Danville held on June ~7 , 1985, and was adopted and ordered published at a meeting of the City Council held on July 1 , 1985 by the following vote: AYES: Lane, May, McNeely, Offenhart z, Schlendorf NOES: None ABSF_,NT: None 'j ' I Mayor !
