The City Council of the Clty of DanviIle DOES ORDAIN AS FOLLOUS:
SECTION 1 _ Rezoninq
"[hat the 146 acre parcel located on the south side of Camino
Tassajara, approximately 1/2 mi].e west of Douchetry Road
<Assessor's Parcel 217-020.-001) and sboun on the attached
Exhibit B is rezoned from A--.2 to the P-Z zoning district_
Rezoning is based upon 'the approved Preliminary Development
Plan for PUD 84--6, as conditioned by the requirements listed
on Exhibit A_
SECTION 2_ Zoninq MaR-
The zoning map of 'the City of Danville is amended
accor-ding19.
SECTION 3_ PubZicatio_n.

SECTION 4. Effective Date
This ordinance becomes effective 30 days after its adoption_
The foregoing ordinance was introduced at a meeting of the City
Council of the City o'f Danville held on April 1S, 198S, and was
adopted and ordered pubiished at a meeting of the Council held
on May 6 , 1985, by the following vote:

CONDITIONS OF APPROVAL
PREL. IHINAR¥ DEVELOPH£N! PLAN
FOR PUD 84-6
1 . This approval is based upon the Preliminary
Development Plan?Preliminary Grading Plan as submitted
by the applicant or] February 4, ]985_ Any revision
including site plans or architecture shall be
submitted for review and approval of the Director of
Planning_
The 'total number of residential units shall not exceed
171 units_ Final number of units uill be determined
at final Development Plan stage
5_ The land uses and millimUm dimensional standards and
requirements for [he principal and accessory
structures on these lots shall be as follows:

north of Camino Tassajara_
5_ The developer shall install a stop sign at the
intersection of the project's major entrance road
with Camino l'assajara_
6_ [he [ intersection of the major entrance road with the
central loop road shall be a Minimum distance of 150
feet from Camino [assajara and include three-way stop
traffic control_
7_ Emergency vehicle access shall be provided from Camino
Tessclara to the parking bays located at the northeast
and northwest corners of the project.
8_ 811 private streets shall he designed consistent with
the draft "Private Street Policy" prepared by the City
of Canville_
9 The roads which run east/west connecting the three
loop roadways, shall haue a MiniMUM pavement width of
i6 feet in each direction_
10_ The Main entrance road into the project should prouide
a MiniMUM pavement width of Z4 feet in each direction_
11_ All private streets shall be signed for no parking_
Sidewalks shall he provided on one side of the street
for each of the three loop roadways, and the ,ajar
entrance road_
[he accent park on the eastern end of the site shall
be designed to prouide for an average of 60 feet in
width, similar to that proposed on the western end.
14_ The accent park/linear parkway SySteM should be
continuous, connecting all three loop roadways_ four
units should be deleted within the central loop
roadway in order to provide for a third accent park_
15. Rn accent park/visual corridor shaJl be provided frOM

16. One unit should be deleted frOM each of the east and
west sides of the Major entrance road. in order to

29. Developer shall participate in an assessment district
or other funding Mechanism for completion of all
requirements contained in the Sycamore Ualley Specific
Plan_ Requirements shall include but not be limited

Acquisition and Improvement of the 20 acre park
site at Camino Tassajara and Sycamore Ualley
Road_
Such participation shall be assured prior 'to issuance
of any building permits for subdivision improvements
or structures.
Covenants, Conditions and Restrictions, Articles of
Incorporation and By-Laws for a mandatory homeowners
association shall be submitted for review by the City
Attorney with the application for approval of a final
Subdivision Map_ These documents shall provide for
establishment, ownership, aud m~intenance of frontyard
landscape for all units and Common Open Space_
31_ The recreation facilities and landscape treatment
along Camino Tassajara shall be be developed with the
first phase of tile project_
-~ 3Z_ Plans for street lighting, signage and entry signage
as required by the Specific Plan shall be submitted
for review of the Director of Pl~rining_ This shall
occur in conjunction ~ith final development plan
submittal to assure compatibility with building
mater-ials, colors and placement. These plans shall be
in comfor'mance with the final landscape plan for
Caminio Tassajara.
Subdivision maps for the development of the area shall
not be recorded until an ordinance adopting this
rezoning has been finalized_
34_ In accordance with Section 9Z-Z.006 of the City
Ordinance Code, this project shall conform to the
provisions of the City subdivision ordinance
<Title 9)_ Any exceptions therefrom must be
specifically listed in the conditional approval
statement, attached to the Tentitive Hap.
Dedicate a drainage easement on Sycamore Creek to
Contra Costa County Flood Control District conforming
to the adopted Floodway Plan.
36 Construct all drainage structures within the property
conforming to the Sycamore Creek Floodway Plan, as
amended in the Addendum to the 1981 E.I_R_

40_ All proposed grading shall be carried out in
accordance with "Grading and Erosion Control
RequireMents" as set forth in the SycaMore Valley
Specific Plan and recoMMendations contained in the
Soil and Geologic Investigation prepared for the
project by Terrasearch Inc_, dated May 1S, 1984_
Sewage disposal serving the project shall be provided
by the Central Contra Costa Sanitary District.
Mater supply serving the project sh.ll be bv the East
Bay Municipal Utility District_
Based upon Mitigation Measures contained in the
E_I_R_, applicant shall prepare and submit an
acoustical study addressing noise Mitigation along the
CaMino fassajara corridor, at time of Final
Development Plan.
44. Storm drain facilities shall be designated to channel
wa'ter into natural drainage ways_ Outfall lines
should be designed to carry water from the edge of
development areas to energy dissipators at nearby
creekbeds in order to MiniMize erosion that will occur
if outlets are placed at the tops of slopes_
Storm drains shall be placed in streets or open space
corridors wherever possible and 'the plan shall be
designed so that thJs can be accomplished without the
pipes being excessively deep.
46_ Grading and land preparation ~hnuld be restricted to
the period of Rpr'll 15 to October 1S to mznimize
eroszon and desposition of sediments in Sycamore
Creek.. All exposed erodable slopes resulting frOM
grading actiuities should be hwdromulched or otherwise
stabilized by project developers each wear bw October
15. Exceptions may be granted hW the Citw Engineer_
47. The City will conduct an off-site noise study_ All
who contribute to noise problems identified bw the
study will be required to participate in an assessment
district for provision of noise Mitigation measures_
Responsibilitw for such participation shall be limited
to a period of time extending two years from
recordation of final maps_
48. Preliminary landscape plans shall be submitted in
conjunction with the Final Development Plan_ Said
plans shall. address all requirements contained in the
P D submittal requirements and shall also include:
o Frontward landscaping for all units including a
minimum of two street trees per unit_
49_ If archaeologic materials are uncovered during
grading, trenching or other exc,]vation, earthwork
__ within 100 feet of these Materia!:s shall be stopped
until a professional archaeologist who is certified by
the Society of California of Archaeology <SCA) and/or
the Societw of Professional Archaeoloow <SOPA> has had
an opportunity to evaluate the significance of the
find and suggest appropriate mitigation Measures, if
they are deemed necessary.
