CZT~_./CLE-RK '3J EX!tIBIT fl CONDITION OF APPROVAL PRELIMINARY DEVELOPMENt PLAN FOR PtlD 84-4 1_ [his approval ts based upon the Preliminary Development Plan/Preliminary Grading Plan as submitted by the applicant on September ZS, 1984 and revised January 1985_ Any revision including site plans or architecture shall be :submitted for review and approval of the Director of Planning_ 2_ The total number of residential units shall not exceed 382 units. Final number o'f units will be determined at final Development Plan stage. Completion of Camino Tassajara. 2_ Completion of Diablo Road between Camino rassajara and 1-680_ 3_ Completion of Sycamore Valley Road. Completion of 1-680/SVcamore Ualley Road interchange or its assurance of completion through other funding sources. Acquisition and IMprovement of the 20 acre park site at Camino Tassajara and Sycanor'e Llalley Road _ Such participation shall be assured prior to issuance of any building permits for subdivision improvements or structures. Covenants, Conditions and Restrictions, Articles of Incorporation and By-Laws for a Mandatory homeowners association shall be submitted for review by the City Attorney with the application for approval of a Final Subdivision Map_ These documents shall provide for establishment, ownership, and maintenance of frontyard landscape for all patio homes and Common Open Space_ The recreation facilities and landscape treatment along Camino Tassajara shall be developed with the first phase of either housing type on either the north or south side of Camino Tassajara_ 34. Plans for street lighting, signage and entry signage as required by the Specific Plan shall be submitted for review of the Director of Planning_ This shall occur in conjunction with final development plan submittal to assure compatibility with buiding materials, colors and placement_ Tb,.:~se plans shall be -~ in conformance with the final landscape plan for Camino fassajara_ Subdivision maps for- the development of the area shall not be recorded until an ordinance adopting this rezoning has been finalized_ 36_ In accordance with Section 92-2.006 of the City Ordinance Code, this project shall conform to the provisions of the City subdivision ordinance <Title 9>_ Any exceptions therefrom must be specifically listed in the conditional approval statement, attached to the Tentative Map_ Dedicate a drainage easement on Sycamore Creek to Contra Costa County Flood Control District conforming to the adopted Floodway Plan_ 38_ Construct all drainage structures within the property conforming to the Sycamore Creek Floodway Plan, as amended in the Addendum to the 1981 E.I_R_. 39_ Abutter's rights of access along Camino fassajara, except for the intersection areas, shall be relinquished- The relinquishment shall include the right of way returns of the affected subdivisions. 40_ All 1riteriot subdivision streets shall be dedicated to the City of Danville and constructed to City pub]ic road standards, or- to the satisfaction of the City Engineer_ Comply with all requirements of the San Ramon Ualley fiire Protection District with respect to emergency vehicle access and all fire code requirements- Developer shall participate in funding the construction of new facilities, amount and extent of which shall be determined prior to final Map recordation_ 42_ Comply with the requirements of tile San Ramon Valley Unified School District as specified in the Sycamore Valley Specific Plan (See addendum 'to 1981E_I_R_)_ fill proposed grading shall be carried out in accordance with "Grading and Erosion Control Requirements- as set forth in the Sycamore Ualley Specific Plan and recommendations contained in the "Preliminary Geotechnica! Exploration" prepared for the project by Engeo, dated September ZO, 198q. Coordinate proposed grading along the eastern property boundary of Area A with the developer to the east in order to minimize slope banks in thi~; area. Sewage disposal serving the project shall be provided by the Centra] Contra Costa Sanitary District.. Uater supply serving the project shall be by the East Bay Municipal Utility District. Based upon mitigation measures contained in the E_I_R_, applicant shall prepare and slJhmit an acoustical study addressing noise mitigation along the Camino Tassajara corridor, at time of fiinal Development Plan. 48_ Storm drain facilities shall be designed to channel water into natural drainage ways_ Outfall lines should be designed to carry water from the edge of developed areas to energy dissipators at nearby creekbeds in order to minimize erosion that will occur if outlets are placed at the tops of slopes_ 49_ Storm drains shall be placed in streets or open space corridors wherever possible and the plan shall be designed so that this can be accomplished without the pipes being excessively deep_ Grading and land preparation should be restricted to the period of April 15 to October 15 to Minimize erosion and deposition of sediments in SyCamore Creek_ All exposed erodable slopes resulting from grading activities should be hydromulched or otherwise stabilized by project developers each year by October ]5_ Exceptions May be granted by the City Engineer. 51_ The City will conduct an off-site noise study,,, All who contribute to noise problems identified by the study will. be required to participate in an assessment district for provision of noise Mitigation measures_ Responsibility for such paritciaption shall be limited to a period of time extending two years frOM recordation of final MapS_ S2_ Preliminary landscape plans shall be submitted in conjunction with the final Development Plan_ Said plans shall address all requirements contained in the P D submittal requirements and shall also include: A_ Frontage landscaping along Camino Tassajara for the existing Shumate residence_ B_ The trianuglar parcel of land at the northwest corner of Camino Tassajara and Sycamore Ualley Road_ C_ frontyard landscaping for all units including a Minimum Of three street trees for all single family lots and two street trees for patio homes_ If archaeologic materials are uncovered during grading, trenching or other excavation, earthwork within lO0 feet of these Materials shall be stopped until a professional archaeologist who is certified by the Society o'f California of Archaeology <SCA) and/or the Society of Professional Archaeology <SOPA) has had an opportunity to evaluate the significance of the fine and suggest appropriate mitigation measures, if they are deemed necessary_ ¼
