HomeMy WebLinkAbout42-84 BEFORE THE CITY COUNCIL OF THE CITY OF DANVILLE IN THE MATTER OF: ) ) Amending the Municipal Code to ) Authorize the Planning Director ) ORDINANCE NO. 42-84 to Decide Certain Variance and ) 'Sign Applications ) ) The City Council of the City of Danville DOES ORDAIN as follows: SECTION 1. Section 2(1) of Ordinance No. 8 (Continuing County ordinances in Effect) is amended to read as follows: "Section 2. Substitution of Appro- priate References to City. Where in the ordinances of the County of Contra Costa which are continued in effect by the City (1) there is a reference to "Planning Commission", "Board of Zoning Adjustment", "Board of Appeal", "Zoning Administrator!~, this reference means the planning agency of the City as established by ordinance except that the Planning Director may hear and decide an application for a variance permit or sign permit if the permit is the only matter before the City and the application contains no other requests;". SECTION 2. Municipal Code §8-104 is amended by adding a new subsection (7) to read as follows: "Section 8-104. General Powers and Duties of Planning Director. The Planning Director has the following powers and duties: (1) provides staff assistance to the City Council, City Manager, and Planning Commission; --1-- (2) serve as secretary to the Planning Commission, or designate an assistant to serve as the secretary. Before the appointment of the first Planning Director or in the absence of the Planning Director or his designee, the City Manager shall designate a person to act as secretary; (3) make surveys, gather data, prepare reports, maps, charts and graphic presentation, adoption and revision of the general plan; (4) enforce the planning and zoning laws of the State and ordinances of the City; (5) conduct the City's environmental review process in accordance with the State Environmental Quality Act and generally be responsible for environ- men~al matters; (6) manage and coordinate all matters concerning housing and commercial buildings; and (7) hear and decide applications as may be authorized by ordinance or elsewhere in this Title." SECTION 3. Publication. The City Clerk shall either a) have this ordinance published once within 15 days after adoption in a newspaper of general circulation or b) have a summary of this ordinance published twice in a newspaper of general circulation, once five days before its adoption and again within 15 days after adoption. SECTION 4. Effective Date. This ordinance becomes effective 30 days after its adoption. The foregoing ordinance was introduced at a meeting of the City Council of the City of Danville held on October ] , 1984, and was adopted and ordered published at a meeting of the Council held on ~ctober 15 -2- 1984,. by the following vote: AYES: Lane, May, Mc Neely, Offenhartz, Schlendorf NOES: None ABSENT: None ATTEST: -3-
