The City Council of the City of Danville ordains as
follows:
Section 1. The City of Danville requests the application
within the City of Sections 416-2.002 -- 416-12.804 of the
Ordinance Code of Contra Costa County relating to animal control
and they shall hereafter so apply under Food and Agricultural
Code Section 3051 and County Ordinance Code Section 416-4.208.
Section 2. The City Council hereby reconfirms the agree-
ment for animal control services authorized on July 5, 1983
which provides that the County will enforce the Ordinance Code
and the Agricultural Code provisions within the City of
Danville and designates and appoints the County's Animal Control
Director and his staff as peace officers of the City for the
purpose of the agreement while enforcing and carrying out its
provisions. A copy of the agreement is on file in the office
of the City Clerk to which reference is made for further
particulars. The agreement shall continue in effect until the
City repeals this ordinance or amends the ordinance to
delete the request for application in the City of the laws
above referred to.
Section 3. A violation of Division 416 (Animal
Control Code), excepting Chapter 416-10 and Article 416-12.2,
is an infraction and is punishable by a fine of not more than
fifty dollars for the first offense, and not more than one
hundred dollars for the second or subsequent offense, as
provided in County Ordinance Code Section 416-4.6.
Section 4. This ordinance is an urgency ordinance for
the immediate preservation of the public peace, health and
safety, within the meaning of Government Code Section 36937,
and the following is a declaration of the facts constituting
the urgency and necessity requiring the immediate effective-
ness of this ordinance:
Contra Costa County Ordinance 80-97 became effective on
April 1, 1981 and was intended generally to provide for animal
control, including licensing, impoundment and protection from
dangerous animals. Under this ordinance, the County provided
animal control services during the City's first year of incor-
poration.
On June 28, 1983, the Board of Supervisors approved a
City-County Animal Services Agreement and on July 5, 1983,
this Council authorized its execution.
The City wishes to continue receiving animal control
services from the County. At the request of the County

Administrator, this ordinance is adopted as an urgency
ordinance in order that the Animal Services Director have
immediate authority within the city limits to continue pro-
viding animal control services in the City and to continue
enforcement of the Animal Control Code.
Section 6. Effective Date.
As an urgency ordinance, this ordinance becomes effective
immediately upon adoption.
Section 7. Publication.
Within fifteen (15) days after its passage, the City Clerk
shall have this ordinance published once in a newspaper of gen-
eral circulation published and circulated in the City and shall
have it posted in three public places designated by resolution
of the City Council.
The foregoing ordinance was introduced at a meeting of the
City Council of the City of Danville held on Auqust 1 , 1983,
and was adopted and ordered published and posted at that same
meeting by the following vote:
