BEFORE THE CITY COUNCIL OF THE CITY OF DANVILLE IN THE ~TTER OF: ) ) Establishing a Municipal ) ORDINANCE NO. 18 Solar Utility ) ) The City Council of the City of Danville, California !~i ~)©FS ORDAIN as follows: Section 1. A new Cha~pter 6, consisting of Section 10-601 and 10-602, is added to Title 10of the Municipal Code reading as follows: "CHAPTER 6 MUNICIPAL SOLAR UTILITY Section 10-601. Purpose. The purpose of this Chapter is to grant authority to the City Council to establish a Municipal Solar Utility. The welfare of the citizens of this City has been jeopardized in the past by shortages of natural gas, petroleum, propane and electric power. The shortage of available energy supplies is expected to continue unless measures are established ! to conserve available energy. It is declared to be the policy h of this City Council to encourage and promote the use of solar I energy in order to prevent or reduce any adverse impact upon i ii the economy and residents of this City due to the shortage of and/or high cost of energy in the future. Section 10-602. Establishment of Solar Utility. This City Council establishes itself as the City of Danville Solar Utility with authority to establish such rules, regulations and procedures as are necessary to implement the policies set forth in Section 10-601." Section 2. This ordinance is declared to be an urgency ordinance for the immediate preservation of the public ~oeace, health, safety and welfare. The facts constitutinq the urgency are as follows: Chapter 1552 of the 1982 Statutes and Amendments allows homeowners who lease solar energy devices from a lessor who had obtained a permit from Municipal Solar Utility to obtain energy tax credits up to amounts of $3,000. To take advantage of this particular benefit, it is necessary for the Municipal Solar Utility to be established before January 1. 1983. Althouqh it is unlikely that citizens of the City of Danville may be able to take advantage of this legislation, it is nevertheless necessary to provide the enabling legislation which will permit citizens to avail themselves of maximum tax credits should they be in a ~osition to do so on the same basis as citizens of other cities in the State which have established a Municipal Solar IT ~ t Utility. The foregoing ordinance was introduced and adopted at a meeting of the City Council of Danville on December 6, 1982, by the following votes: AYES: Lane, May, Mc Neely, Offenhartz, Schlendorf.
