Declaration of intent. Under the authority of Government Code Section 35441, the City Council adopted Ordinance No. 1 on July 1, 1982. This ordinance provides that each ordinance of Contra Costa County ~ applicable before incorporation shall remain in full force and effect as a city ordinance for a period of 120 days or until the ! Council enacts an ordinance superceding it. Ordinances continued in effect by Ordinance No. 1 reflect the county governmental structure and contain references to officials, official titles, commissions and other official designations which are not a part of the structure of this City's government. To effectively and intelligently administer the County Ordinances to the extent that they are continued in effect by Ordinance No. 1, it is the purpose of this Ordinance to provide for the substitution of the appropriate City official, title or designation in County Ordinances. Section 2. Substitution of appropriate references to City. Where in the Ordinances of the County of Contra Costa which are continued in effect by the City, " " "Board (1) there is a reference to "Planning Commission, of Zoning Adjustment," "Board of Appeals," or "Zoning Administrator,', this reference means the planning agency of the City as established by ordinancet (2) There is a reference to "Board of Supervisors," this reference means the City Council of the City of Danville. (3) There is a reference to an office, official title, person or other designation, the reference means that office, title, person or designation in the governmental structure of the City who performs the functions referred to or the duties imposed. Section 3. Taking Effect This ordinance is declared to be an urgency ordinance and is for the immediate preservation of the public peace, health and safety. This ordinance takes effect immediately. The facts constituting the urgency are that the City of Danville is newly incorporated and has continued County Ordinances in effect. The Ordinance Code of Contra Costa County refers to agencies, boards, commissions, titles and offices which do not exist in the governmental structure of the City. This ordinance is necessary in order to clarify and assist in interpreting which agency or person in the city government performs functions which are designated by County Ordinances to be performed by officers, boards, and commissions which do not exist in the structure of this City government. iI Section 4. Posting Within 15 days after the passage of this ordinance, the -2- city clerk shall cause it ~o be posted in the 3 public places designated by resolution of the City Council.
