APPROVING DEVELOPMENT PLAN REQUEST DEV14-0094 ALLOWING FOR
THE CONSTRCUTION OF A 912+/- SQUARE FOOT DETACHED GARAGE WITH
AN ATTACHED CARPORT LOCATED WITHIN A TOWN -IDENTIFIED MAJOR
RIDGLINE AREA
(APN:197-120-022) - 315 EL PINTO ROAD
WHEREAS, Nikhil & Nanda Purohit (OWNER) and Rush Shatt (APPLICANT) have
requested approval of a Development Plan application (DEV14-0094) to allow the
construction of a 912 +/- square foot detached garage with an attached carport on a 2.47
acre parcel; and
WHEREAS, the subject property is located at 315 El Pinto Road, APN:197-120-022; and
WHEREAS, the Town of Danville's Major Ridgeline and Scenic Hillside Development
Ordinance requires approval of a Development Plan application prior to development
within a Town -identified Major Ridgeline area; and
WHEREAS, the project has been found to be Categorically Exempt from the
Requirements of the California Environmental Quality Act (CEQA), Section 15303, Class
3; and
WHEREAS, the Planning Commission did review the project at a noticed public
hearing on November 25, 2014; and
WHEREAS, the public notice of this action was given in all respects as required by law;
and
WHEREAS, a staff report was submitted recommending that the Planning Commission
approve this request; and
WHEREAS, the Planning Commission did hear and consider all reports,
recommendations, and testimony submitted in writing and presented at the hearing;
now, therefore, be it
RESOLVED that the Danville Planning Commission approves Development Plan
request DEV14-0094 and makes the following findings in support of this action:
FINDINGS OF APPROVAL:
1. The proposed siting and architecture of the detached accessory structure will not
conflict with the intent and requirements of the Major Ridgeline and Scenic
Hillside Development Ordinance because development will be achieved with
minimal grading and will not adversely impact predominate views of a Town -
identified Major Ridgeline area.
2. The proposed development is in conformance with the goals and policies of the
Danville 2030 General Plan because the development will be integrated in a
manner that is compatible with the physical character of the surrounding
community.
3. The proposed development is in conformance with the zoning district in which
the property is located because the proposed detached accessory structure will be
established consistent with the structure setback and maximum structure heights
set forth by the R-100; Single Family Residential District applicable to this
property.
CONDITIONS OF APPROVAL:
1. This approval is for Development Plan request DEV14-0094, authorizing the
construction of a 912 +/- square foot detached garage with an attached carport
on a 2.47 +/- acre parcel. Except as may be modified by these conditions of
approval, development shall be as shown on the project plans received by the
Planning Division on November 10, 2014 for 315 El Pinto consisting of 4 sheets,
as prepared by Jurado Design & Drafting.
2. The applicant shall pay or be subject to any and all Town and other related fees
that the property may be subject to. These fees shall be based on the current fee
schedule in effect at the time the relevant permits are secured, and shall be paid
prior to issuance of said permit.
3. Construction activity shall be restricted to the period between the weekday hours
of 7:30 a.m. to 5:30 p.m. (Monday through Friday), unless otherwise approved in
writing by the City Engineer for general construction activity and the Chief
Building Official for building construction activity.
4. Prior to the issuance of a building permit, the applicant shall reimburse the Town
for costs incurred to notify neighboring residents of the proposed development
plan. request. Reimbursement shall be in the amount of $158.22 ($130.00 plus 34
notices X $0.83 per notice) made payable to the Town of Danville.

APPROVED by the Danville Planning Commission at a regular meeting on November
25, 2014 by the following vote:
