RECOMMENDING THAT THE TOWN COUNCIL APPROVE
ZONING TEXT AMENDMENT LEG12-02 (ZTA) ESTABLISHING
A NEW SECOND DWELLING UNIT ORDINANCE
WHEREAS, The Town of Danville has initiated Zoning Text Amendment LEG12-02
(ZTA) to amend Section 32-76 -Second Dwelling Unit Ordinance of the Danville
Municipal Code; and
WHEREAS, an amendment to a Town Ordinance requires approval of a Zoning Text
Amendment; and
WHEREAS, the Second Dwelling Unit Ordinance would apply to lands identified
within the Danville 2010 General Plan; and
WHEREAS, the Second Dwelling Unit Ordinance would establish the purpose, Town
review process; and design and development standards for second dwelling units
developed in the Town; and
WHEREAS, the Second Dwelling Unit Ordinance would eliminate previously
established owner occupancy requirements and associated deed recordation
requirements; and
WHEREAS, the Second Dwelling Unit Ordinance would establish an amnesty program
to facilitate the goal of bringing illegal units into compliance; and
WHEREAS, the Second Dwelling Unit Ordinance would establish a deed restriction, for
units legalized under the amnesty program, as affordable housing for a minimum of ten
years; and
WHEREAS, the Planning Commission did review the zoning text amendments at a
noticed public hearing on October 9, 2012; and
WHEREAS, the zoning text amendment is statutorily exempt from CEQA and no
significant environmental impacts are expected to be associated with the adoption of
this ordinance; and
WHEREAS, the public notice of this action was given in all respects as required by law;
and
WHEREAS, a staff report was submitted recommending that the Planning Commission
approve the request; and
WHEREAS, the Planning Commission did hear and consider all reports,
recommendations, and testimony submitted in writing and presented at the hearing;
now, therefore, be it
RESOLVED that the Planning Commission of the Town of Danville recommends that
the Town Council approve Zoning Text Amendment LEG12-02 (ZTA).
APPROVED by the Danville Planning Commission at a regular meeting on October 9,
2012 by the following vote:
YES: Graham, Heusler, Morgan, Overcashier
NOES:
ABSTAIN: Attwood, Combs, Radich
