DENYING, WITHOUT PREJUDICE, THE APPEAL AND UPHOLDING PLANNING
DIVISION DENIAL OF SIGN REVIEW APPLICATION SR11 -0008 WHICH
REQUESTED APPROVAL OF BUSINESS IDENTIFICATION SIGNAGE FOR THE
IRON HORSE DELI AND JUST FUN BUSINESSES
(APN:199- 330 -035)
WHEREAS, the Iron Horse Deli and Just Fun businesses requested approval of Sign
Review application SR11 -0008, which requested authorization for business identification
signage for the two businesses; and
WHEREAS, the subject site is located at 115 Hartz Avenue and is further identified as
Assessor's Parcel Number 199 - 330 -035; and
WHEREAS, the Town of Danville Sign Control Ordinance requires approval of a Sign
Review permit prior to the installation of business identification signage; and
WHEREAS, the Planning Division denied SR11 -0008 on November 22,2011; and
WHEREAS, Iron Horse Deli and Just Fun submitted a letter appealing the Planning
Division's action on December 2, 2011; and
WHEREAS, the project has been found to be Categorically Exempt from the requirements
of the California Environmental Quality Act (CEQA) Class 11, Section 15311; and
WHEREAS, the Planning Commission did review the project at a noticed public hearing on
January 24, 2012; and
WHEREAS, the public notice of this action was given in all respects as required by law;
and
WHEREAS, a staff report was submitted recommending that the Planning Commission
deny the appeal; and
WHEREAS, the Planning Commission did hear and consider all reports, recommendations,
and testimony submitted in writing and presented at the hearing; now, therefore, be it
RESOLVED that the Planning Commission of the Town of Danville denies, without
prejudice, the appeal and upholds the Planning Division's denial of Sign Review
application SR11 -0008, and makes the following findings in support of this action:
1. The signage would not be consistent in character with the Town's commercial
design guidelines, is not compatible with project architecture, and is larger than
necessary for adequate identification. The wall signs that have been installed for the
Just Fun business do not provide sufficient dimensional relief, do not meet the
minimum one and one -half inch thickness required by the Town's Sign Control
Ordinance and are out of character with other signs in the area. Additionally, the
wall sign that has been installed for the Iron Horse Deli is approximately 48 square
feet, which is out of scale with the receiving wall area and is significantly larger than
wall signs on similarly sized building frontages in the surrounding area. The
business frontage is approximately 20 linear feet, allowing for a maximum sign size
of 15 square feet based on the regulations contained within the Town's Sign Control
Ordinance.
2. The signage would excessively compete for the public's attention due to the colors
and design of the Just Fun signs that are not compatible with the architectural style
of the building or environment of which they are a part.
APPROVED by the Danville Planning Commission at a regular meeting on January 24,
2012 by the following vote:
