RESOLUTION NO. 2010-18
APPROVING AN AMENDMENT TO THE CONDITIONS OF APPROV AL FOR
MAJOR SUBDIVISION SD 8219, A PREVIOUSLY APPROVED
FIVE-LOT RESIDENTIAL SUBDIVISION
(APN: 206-570-001, 002, 003, 004 & 005)
WHEREAS, KURT ZIMMERMAN (Owner) had requested approval of an amendment to
the conditions of approval for previously approved Major Subdivision 8219, removing the
requirement to underground the existing overhead utilities along Lawrence Road; and
WHEREAS, the subject 11.40 acre site is located at the intersection of Lawrence Road and
Hidden Hills Place and is further identified as Major Subdivision SD 8219; and
WHEREAS, the Planning Commission did review and approve the Major Subdivision
request at a noticed public hearing on March 14,2000; and
WHEREAS, Condition of Approval G.16. of Planning Commission Resolution No. 2000-08
requires the undergrounding of the existing overhead utilities along the project's Lawrence
Road frontage; and
WHEREAS, the Planning Commission did review the request at a noticed public hearing
on July 13, 2010; and
WHEREAS, the public notice of this action was given in all respects as required by law;
and
WHEREAS, a staff report was submitted recommending that the Planning Commission
approve the request; and
WHEREAS, the Planning Commission did consider the request in writing and presented at
the hearing; now, therefore, be it
RESOLVED that the Planning Commission of the Town of Danville approves the request
to eliminate condition of approval G.16 of Resolution No. 2000-08 related to the
undergrounding of the existing utilities along the Lawrence Road Frontage and makes the
following findings in support of this action:
1. The design of the subdivision is in substantial conformance with the goals and
policies of the Danville 2010 General Plan.
2. The design of the subdivision is in substantially conformance with the development
standards contained within the LawrencejLeema Road Specific Plan.
3. The design of the subdivision is in substantial conformance with the applicable
zoning regulations.
4. The design of the subdivision and the type of associated improvements are in
conformance with the surrounding developments.
5. The requirement to underground existing overhead frontage utilities was not
required as a condition of approval for any of the other subdivisions in the
Lawrence Road area.
APPROVED by the Danville Planning Commission at a regular meeting on July 13, 2010,
by the following vote:
