RESOLUTION NO. 2010-05
APPROVING DEVELOPMENT PLAN REQUEST DEV09-0094 RELATED
TO ARCHITECTURE AND LANDSCAPE DESIGN FOR A
PREVIOUSLY APPROVED EIGHT LOT SUBDIVISION
AT 150 HILL ROAD (APN: 196-330-054 THROUGH 061)
WHEREAS, DAVIDON HOMES (Owner/Applicant) has requested approval of a
Development Plan request for approval of architecture and landscaping for seven
previously approved lots on a 4.6 + / - acre site; and
WHEREAS, the subject property is located at 150 Hill Road and is further identified as
APN: 196-330-054,55,56,57,58,59,60, and 61; and
WHEREAS, the Conditions of Approval for Major Subdivision request SD 8641 require
that the architectural design for the new homes and associated landscape plans be
submitted for review and approval by the Design Review Board and Planning
Commission under a separate Development Plan application; and
WHEREAS, A Mitigated Negative Declaration of Environmental Significance was
previously approved for this project; and
WHEREAS, the Planning Commission did reVIew the project at a noticed public
hearing on January 26,2010; and
WHEREAS, the public notice of this action was given in all respects as required by law;
and
WHEREAS, a staff report was submitted recommending that the Planning Commission
approve the request; and
WHEREAS, the Planning Commission did hear and consider all reports,
recommendations, and testimony submitted in writing and presented at the hearing;
now, therefore, be it
RESOLVED that the Danville Planning Commission approves Development Plan
request DEV09-0094 and makes the following findings in support of this action:
FINDINGS:
1. The proposed development will not be detrimental to the health, safety, and
general welfare of the Town.
2. The development will not adversely affect the orderly development of property
within the Town.
3. The development plan will not adversely affect the preservation of property
values and the protection of the tax base within the Town.
4. The development plan will not adversely affect the policy and goals as set by the
2010 General Plan.
5. The land use will not create a nuisance and\ or enforcement problem within the
neighborhood or community.
6. The land use will not encourage marginal development within the
neighborhood.
CONDITIONS OF APPROVAL:
Unless otherwise specified, the following conditions shall be complied with prior to the
issuance of the initial building permit for the project. Each item is subject to review and
approval by the Planning Division unless otherwise specified.
1. This permit is for a Development Plan request approving architecture and
landscaping for seven previously approved lots. The proposed homes include
five different floor plans, ranging in size from 3,906 square feet to 4,845 square
feet. Two 450+/- square foot second dwelling unit" cottages" are also proposed.
Except as may be modified by the conditions of approval contained herein,
development shall be substantially as shown on the project drawing as follows:
a. Architectural elevations, floor plans, roof plans and details labeled
"Encantada," as prepared by Bassenian Lagoni Architects, consisting of 30
sheets, dated received by the Planning Division on December 4,2009.
b. Composite Plot Plan labeled "Encantada," as prepared by dk Consulting,
dated received by the Planning Division on December 24, 2009.
c. Street Tree and Fencing Plan labeled "Encantada Subdivision 8641," as
prepared by Environmental Foresight, Inc., consisting of two sheets, dated
received by the Planning Division on December 24,2009.
d. Typical Front Yard Landscaping Plan labeled "Encantada Subdivision 8641,"
as prepared by Environmental Foresight, Inc. consisting of 3 sheets, dated
received by the Planning Division on December 24,2009.

2. The fence at the northeast corner of Hill Road and Claire Drive shall be modified
to comply with the Town's Sight Obstructions and Intersections Ordinance
requirements. In addition, the rear fences for Lots 6 and 7, along Hill Road, shall
be modified to maintain a minimum 5 foot setback from the Hill Road and to
include landscaping and irrigation on the outside of the fence. Keystone type
blocks shall be used to create a mostly flat area between the fence and the road.
3. The proposed London plane street tree shall be replaced with either scarlet
maple or flowering pear trees.
4. Colors and materials for the homes shall consistent with the color and material
boards on file with the Planning Division.
5. All conditions of approval previously approved under Town Council Resolution
No. 38-2003 shall continue to be applicable to this development.
APPROVED by the Danville Planning Commission at a regular meeting on January 26,
2010 by the following vote:
