HomeMy WebLinkAbout2008-02 RESOLUTION NO. 2008-02 APPROVING DEVELOPMENT PLAN REQUEST DP 2005-26 ALLOWING MODIFICATIONS TO THE DANVILLE SQUARE PARKING LOT AND ESTABLISHING A PARKING MANAGEMENT PLAN (APN: 199-330-060, 061, 062 - DANVILLE SQUARE) WHEREAS, the Edward Ageno 1992 Trust (Owner) has requested approval of a revised Development Plan to allow modifications to the Danville Square shopping center parking lot. The plan would result in 13 additional on-site parking spaces and 10 additional employee parking spaces on the triangular parcel across Railroad Avenue. The request also includes a Parking Management Plan to maximize the use of on-site parking; and WHEREAS, the subject site is located at 1-99 Railroad Avenue, and is also identified as Assessor's Parcel Numbers 199-330-060,-061, 062; and WHEREAS, approval of a revised Development Plan application is necessary prior to amending the previously approved design of the shopping center and to establish a Town sanctioned Parking Management Plan; and WHEREAS, the Danville Planning Commission did review the project at a noticed public hearing on February 26, 2008; and WHEREAS, the project has been found to be Categorically Exempt from the California Environmental Quality Act (CEQA), Class 4, Section 15304; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that the Planning Commission approve the request; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED that the Planning Commission of the Town of Danville recommends that the Planning Commission approve Development Plan request DP 2005-26, and makes the following findings in support of this action: FINDINGS 1. The applicant intends to obtain permits for construction within 18 months from the effective date of plan approval. 2. The proposed development is consistent with the General Plan and the Downtown Master Plan. 3. Traffic congestion will not likely be created by the proposed center or will be obviated by: a. presently projected projects; b. proper entrances and exits; c. internal provisions for traffic or parking; d. parking plans and agreements. 4. The development will be an attractive and efficient development which will fit harmoniously into and will have no adverse effects upon the adjacent or surrounding development. 5. The proposed project is consistent with the Danville 2010 General Plan and the Downtown Business District Ordinance. 6. The proposal will not be detrimental to the health, safety, and general welfare of the Town. CONDITIONS OF APPROVAL Unless otherwise specified, the following conditions shall be complied with prior to occupancy of the final phase of the Danville Square development. Each item is subject to review and approval by the Planning Division unless otherwise specified. 1. Unless modified by the following conditions of approval, development and operation of the Danville Square shopping center parking lot shall be as described in the following document/ plan: a. Booklet titled "Danville Square Parking Program," as prepared by David Gould, Colliers International, dated July I, 2007. b. Plan labeled "Danville Square Parking Improvements," as prepared by David B. Hop Engineering, dated May 30, 2007. PAGE 2 OF RESOLUTION NO. 2008-02 2. The parking demand for the mix of uses within the shopping center, as allowed for under the subject site's Downtown Business District 4; Residential Serving Con:unercial zoning designation, shall not exceed the on and off-site parking supply (260 spaces). Should the ten off-site employee parking spaces ever be eliminated, the parking demand for the mix of uses shall be adjusted (replacing higher intensity uses with lower intensity uses over time as the higher intensity uses choose to vacate the center) to meet the new parking supply (250 spaces). 3. The proposed tube steel gate at the exit of the rear parking lot onto Love Lane shall be subject to review and approval by the Planning Division prior to issuance of building permits. 4. Prior to initiation of the parking lot modifications, the applicant shall submit to the Town a phasing plan. The goal of the phasing plan shall be to minimize temporary parking impacts in the shopping center. 5. The applicant shall install a minimum five foot wide sidewalk along the frontage of the rectangular parcel on the east side of Railroad Avenue (APN: 199-330-055). 6. The applicant shall work with the Town of Danville Traffic Department and Engineering Division to determine the possibility of allowing right-turn exiting movements from the northernmost driveway onto Railroad Avenue. If determined acceptable by the Town, the parking lot modifications shall include this provision.
