APPROVING DEVELOPMENT PLAN REQUEST DEV07-0046
(APN: 208-021-010 - FACADE REMODEL)
WHEREAS, ASWAD PROPERTIES LLC (Owner) and CRAIG & GRANT ARCHITECTS
(Applicant) have requested approval of Development Plan DEV07-0046 to allow a
facade remodel, including painting and new facade materials, new signage, a trash
enclosure, landscape and a new 170 +/-square foot lobby area; and
WHEREAS, the subject site is located at 452 Hartz Avenue and is further identified as
Assessor's Parcel Number 208-022-010 ;and
WHEREAS, the Town of Danville Downtown Business District Ordinance requires
approval of a Development Plan application prior to completion of proposed site
improvements; and
WHEREAS, the Planning Commission did review the project at a noticed public
hearing on November 27, 2007; and
WHEREAS, this project is Categorically Exempt from the requirements of the California
Environmental Quality Act (CEQA), Section 15301 (Existing Facilities); and
WHEREAS, the public notice of this action was given in all respects as required by law;
and
WHEREAS, a staff report was submitted recommending that the Planning Commission
approve the request; and
WHEREAS, the Planning Commission .did hear and consider all reports,
recommendations, and testimony submitted iri writing and presented at the hearing;
now, therefore, be it
RESOLVED that the Planning Commission of the Town of Danville approves
Development Plan request DEV07-0046 per the conditions contained herein, and makes
the following findings in support of this action:
Development Plan:
1. The applicant intends to obtain permits for construction within 18 months from
the effective date of plan approval.
2. The development will be an attractive and efficient development which will fit
harmoniously into and will have no adverse effects upon the adjacent or
surrounding development.
3. The proposed project is consistent with the Danville 2010 General Plan and the
Downtown Business District Ordinance.
4. The proposal will not be detrimental to the health, safety, and general welfare of
the Town.
CONDITIONS OF APPROVAL:
Conditions of approval with an asterisk ("*") in the left-hand column are standard
project conditions of approval. Unless otherwise specified, the following conditions
shall be complied with prior to the issuance of a building permit for the project. Each
item is subject to review and approval by the Planning Division unless otherwise
specified.
1. Except as may be modified by the conditions contained herein, the exterior
modifications authorized by this permit shall be substantially as shown on the
site plan, floor plan and building elevations consisting of seven sheets, as
prepared by Craig & Grant Architects, Inc., dated received by the Planning
Division on November 13, 2007. This approval authorizes a facade remodel,
including painting and new facade materials, new signage, a trash enclosure,
landscape and a new 170 +/- square foot lobby area.
2. All necessary building permits shall be secured prior to initiating the proposed
building modifications. Planning Division sign-off is required prior to final
building inspection sign-off by the Building Division. Prior to issuance of a
building permit, written documentation that the requirements of the San Ramon
Valley Fire Protection District have or will be met to the satisfaction of the
District shall be submitted to the Town.
3. The exterior building colors and materials used for this remodel project shall be
as depicted on the project color and materials board on file in the Planning
Division.
4. As a part of the issuance of a building permit for the project, the applicant shall
provide a recycling plan for building and construction materials and the disposal
of waste generated from the site. Prior to obtaining framing inspection approval
for the project, the applicant shall provide the Planning Division with receipts
indicating that waste materials generated from the site are being recycled
according to their recycling plan or in an equivalent manner.

5. Prior to the issuance of a building permit, the applicant shall reimburse the Town
for notifying surrounding neighboring residents of the application submittal.
The fee shall be $78.85 (95 notices X $0.83 per notice).
6. The street address number for the structure shall be posted so as to be easily seen
from the street at all times, day and night.
7. New or modified exterior lighting established in conjunction with the remodel
project shall be established and maintained at minimal functional levels of
brightness. Light sources shall be screened to direct light on-site and to screen
the light source from off-site views. Light fixtures shall be kept low to the
ground.
8. All plant material shall be served by an automatic underground irrigation system
and maintained in a healthy growing condition. Landscaping and irrigation
improvements shall be installed prior to building permit final sign-off.
9. The applicant shall obtain an encroachment permit from the Town Engineering
Division prior to commencing any construction activities within the public
right-of-way. No concentrated drainage shall be permitted to surface-flow across
the public sidewalk or curb.
10. Any damage to street improvements now existing or done during construction
on or adjacent to the subject property shall be repaired to the satisfaction of the
City Engineer, at full expense to the applicant.
11. The project shall be constructed as approved. Staff may approve minor
modifications in the design, but not the use. Any other changes will require
approval through the Development Plan review process.
12. The applicant shall pay all Town and other related fees applicable to the subject
property. These fees shall be based on the current fee schedule in effect at the
time the relevant permits are secured, and shall be paid prior to issuance of said
permit. Notice should be taken specifically of the following fees:
